Bathroom Giveaway Terms and Conditions -- All applicants must be 18 years old or older to enter. No purchase necessary. A purchase will not increase your chances of winning. Winners will be drawn from all entries received online. -- The prize has no cash value and winner will be awarded $10,000 in equivalent Armstrong Building Services products and installation. Winner is not transferable, and entrant must own a single-family residence in lower Michigan.  -- Entry: Entries must be completed within the applicable giveaway dates from 11/01/2023 to 12/31/2024. Eligibility for Entry: Winner will be drawn at random on 1/07/25. By Submitting this entry form I am authorizing Armstrong Building Services to contact me by phone or email regarding this contest and/or our services. All work must be completed in our area of work with products we supply. One entry per household. Also, applicant must be a legal resident of the state of Michigan.  -- Non-eligibility or non-compliance with any of these Official Rules will result in disqualification. Void where prohibited or restricted by law. (For the avoidance of doubt, any references in these Rules to Entrants shall also include the Entrants who are deemed the Winner (as defined below). -- AGREEMENT TO OFFICIAL RULES: By participating, applicants and entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Giveaway. Limit one (1) entry per Entrant. Proof of entry information at the Website is not considered proof of delivery to or receipt by -- Sponsor of an entry. Entries made by any other individual or any entity, and/or originating at any other website or email address, including, but not limited to, commercial Giveaway subscription notification and/or entering service sites, will be declared invalid and disqualified for this Giveaway. -- The use of automated entry devices is prohibited, and no mechanically reproduced entries are allowed; all such entries are void. Released Parties are not responsible for: late, incomplete, delayed, undelivered, or misdirected entries. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. -- By participating, you consent for Sponsor to obtain, use, and transfer your name, address and other information for the sole purpose of administering this Sweepstakes.  -- Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.  -- GENERAL CONDITIONS: If for any reason the operation or administration of this “Bathroom Giveaway” is impaired or incapable of running as planned for any reason, including but not limited to (i) infection by computer virus, bugs; (ii) tampering, unauthorized intervention; (iii) fraud; (iv) technical failures or (v) any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Bathroom Giveaway, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Giveaway in whole or in part, at any time, without notice and award the Prizes (defined below) using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules. -- Sponsor reserves the right, at its sole discretion, to disqualify any individual deemed to be tampering or attempting to tamper with the entry process or the operation of the Giveaway or Sponsor’s Website; or acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. -- CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE; THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.   -- RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Giveaway, Entrants agree to release and hold harmless the Released Parties from and against any claim or cause of action arising out of participation in the giveaway or receipt or use of any Prize, including, but not limited to: (i) any technical errors that may prevent an Entrant from submitting an entry; (ii) unauthorized human intervention ; (iii) errors in the administration of the giveaway or the processing of entries; or (v) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the giveaway or receipt of any Prize.  Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to Entrant’s or any other person’s computer relating to or resulting from participation in this giveaway or downloading any materials in this giveaway. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the bathroom giveaway, and in no event shall the Released Parties be liable for attorney fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.  Except as expressly provided above, IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS BATHROOM GIVEAWAY OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF A PRIZE.  By participating, Entrants release and agree to hold harmless the Released Parties from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this bathroom giveaway or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of a Prize. -- Released Parties are not liable in the event that any portion of the bathroom giveaway is cancelled due to weather, fire, strike, acts of war or terrorism, pandemic, or any other condition beyond their control. -- EACH ENTRANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER STATE OF MICHIGAN AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE UNITED STATES ARE HEREBY EXPRESSLY WAIVED BY HIM/HER.  SECTION READS AS FOLLOWS: “CERTAIN CLAIMS NOT AFFECTED BY A GENERAL RELEASE. A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.” -- Selection: Winners will be selected from among all eligible entries in a random drawing. The drawing will be conducted in the Bathroom Planet offices on or around the week of January 1st, 2023. All decisions relating to the sweepstakes winner are final. -- Notification: Winners will be notified by mail, phone, and/or email. Limit one prize per homeowner. Prizes are non-transferable and substitutions are not permitted. All federal, state, and local taxes are the sole responsibility of each winner. Potential winners may be required to sign and return an Affidavit of Eligibility, Release of Liability, Content Assignment, and/or Prize Acceptance form and be postmarked within 10 days of the date of notification materials. Noncompliance within this time period and/or return of any prize/prize notification as undeliverable may result in disqualification. Decisions of sponsor are final on all matters. Should the winner of any prize decline participation for any reason, substitute entries will not be drawn. -- Prize: The Grand Prize consists of a wet-area bathroom remodel. The wet area consists of the bathtub or shower space and does not include elements outside of that space (vanity, toilet, flooring, cabinetry, and so on.) The maximum value of the Grand Prize is $10,000. If the final remodel costs less than $10,000, the remaining amount is not eligible to be redeemed for cash or other prizes. -- Publicity/Marketing: Except where prohibited, your entry in this giveaway constitutes your consent to sponsor to use of your name, likeness, photograph, voice, opinions, hometown and state or province, and entry (with or without attribution) for promotional purposes in any media, worldwide and without further payment or consideration. In addition, sponsors shall have the right to use your contact information supplied in connection with these sweepstakes (postal address, telephone number, email address, etc.) for marketing and promotional purposes -- Cancellation: Sponsor reserves the right, in its sole discretion, to cancel, suspend or modify this giveaway if: (a) a virus, bugs, or other causes beyond the control of the sponsor corrupt the administration, security or proper operation of the giveaway ; (b) fraud, misconduct or technical failures destroy the integrity of the giveaway as determined by sponsors, in their sole discretion; and (c) any other circumstances, as determined in sponsor’s sole discretion, significantly impacting the integrity, fairness or proper operation of the giveaway. -- Additional Terms: It is your sole responsibility to notify the sponsor of any changes to your contact information. Any attempt by you to obtain more than the allowed number of entries for any drawing by using multiple/different addresses, identities, or any other methods will disqualify you from this sweepstakes and chance of winning any prize. Use of any automated system to enter is prohibited and will result in disqualification. The sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process.
